Hi experts,
I passed Appendix IIIA - SO(A) group, 2006. Two candidates who have been ten years juniors to me in the JAA/AA seniority list but passed TIA group, 2004 (qualified in the SO group in 2006) have been assigned seniority ahead of me in the SO Panel, 2006.1) Is this naturally justified? (A person can lose seniority because of punishments or branching out etc. But the question of gaining seniority is meaningless because seniority is synonymous with continuity of service and hence no one can be tugged ahead of his seniors.)
2) Is it possible to interpret the provisions in para 320 of IREM as candidates holding higher post can be given higher seniority? Para 320 merely stipulates that iner-seniority in the case of candidates from different seniority units should be reckoned based on the total length of service in the equivalent or same grade. So it is possible to interpret that service in the higher grade can also be considered since same/equivalent grades are considered but not that holding higher post altogether confers higher seniority.3) For fixation of panel what is the cut-of-date? Is it the date of application or the date of last exam or date of declaration of results? As per exam notification a candidate should hold the eligibility criteria for appearing IIIA exam by the date of application.
My administration says it is the age old procedure interpreted from para 320 of IREM, but did not show any other rule or clarification given by competent authority.Please advice.
