7.36.50 The demand for placement of the categories of Loco Pilot Mail Express, Loco Pilot Passenger I, Senior Motorman in the scale
of Rs.6500-10500 is no longer justified as the scale of Rs.6000-9800 is not a regular pay scale and was specifically created for this category because they were bursting out of the maximum of the earlier pay scale of Rs.5500-9000. In the revised scheme of running pay bands and grade pay, no such bursting is possible. Accordingly, the post should normally have been given only the replacement pay band and grade pay corresponding to the pre-revised pay scale of Rs.5500-9000. However, the Commission is recommending merger of the pre-revised pay scales of Rs.5000-8000, Rs.5500-9000 and Rs.6500-10500. The post will, therefore, automatically be upgraded. This would also necessitate upgradation of the higher categories so as to ensure that feeder and promotion posts do not come to lie in an identical pay scale. The Commission, accordingly, recommends the following pay structure for Loco Running Staff:-

On account of more onerous nature of work as well as process of selection involved, Loco Pilots for passenger trains shall be given an additional allowance of Rs.500 p.m. Loco Pilot for mail/express trains will be given this allowance at the rate of Rs.1000 p.m. Dearness allowance shall be payable on this allowance. The existing parity with cadre of Guards, for other allowances like running allowance, may also be retained in respect of this allowance which is being recommended for the first time.
7.36.51 The demand for providing insurance cover appears justified and the Ministry should work out a scheme for providing such insurance cover. The demands for other allowances specifically for this category are not merited. Consequently, these demands cannot be conceded.

Subject :- Merger of 50% of Dearness Allowance/ Dearness Relief with basic pay/ pension to Railway employees/pensioners wef 1.4.2004.

The Fifth CPC in para 105.11 of their Report had recommended that DA should be converted into Dearness Pay each time the CPI increases by 50% over the base index used by the last Pay Commission.
2. This recommendation of Fifth CPC has been considered and the President is pleased to decide that with effect from 1.4.2004, DA equal to 50% of the existing basic pay shall be merged with the basic pay and shown distinctly as Dearness Pay (DP) which would be counted for purposes like payment of allowances, transfer grant, retirement benefits, contribution to GPF, Licence Fee, Monthly contribution for CGHS, various advances, etc. The entitlements for Privilege Pass/ PTO/Duty Pass, TA/DA while on tour and transfer and government accommodation shall, however, continue to be governed on the basis of the basic pay alone without taking into account Dearness Pay. In case of existing pensioners, Dearness Relief equal to 50% of the present pension will w.e.f 1.4.2004, be merged with pension and shown distinctly as Dearness Pension. Dearness Allowance/ Dearness Relief converted into Dearness Pay/ Dearness Pension respectively would be deducted from the existing rate of Dearness Allowance/ Dearness Relief.
3. As regards running staff, the recommendations of the 'Committee on Running Allowances - 2002' are expected shortly. Pending receipt of recommendations of the above Committee and Government's decision thereon, it has been decided that Dearness Pay for the purpose of calculation of retirement benefits in the case of running staff, may provisionally be calculated on basic pay + 30% thereof. Accordingly, emoluments for retirement benefits in the case of running staff retiring on or after 1.4.2004 would consist of Basic Pay + 55% thereof (as pay element component for retirement benefit) plus Dearness Pay at the appropriate percentage calculated on Basic pay + 30% thereof. Regarding calculation of Dearness Pay for the specified benefits where 30% pay element is reckoned at present, Dearness Pay for these purposes, except those excluded in para 2 above, would also provisionally be calculated on Basic Pay + 30% thereof.
4. To ensure that pensioners retiring between 1.4.2004 to 31.1.2005 do not face any loss in fixation of pension, as special dispensation in their case, DA equal to 50% of the basic pay would be treated as basic pay for purposes of computation of pension in respect of basic pay received by them prior to 1.4.2004. Consequently, element of Dearness pension will, exist only for pensioners retired/ retiring from Government of India up to 31.3.2004.

Please refer to Board's letter of even number dated 30.6.2004 (RBE 140/2004) on the above subject wherein an illustration showing the method to be followed for calculation of emoluments of serving Running staff consequent upon issue of Board's letter No. PC-V/2004/A/DA/1 dated 11.3.2004 (RBE 57/2004) was given.
2. It has been represented to the Board that subsequent to issue of letter dated 11.3.2004 (RBE 57/2004) ibid, there has been drop in the pensionary benefits of running staff retiring on/after 1.4.2004 with reference to running staff who had retired prior to 1.4.2004. The issue has, therefore, been examined by the Board and it has been decided that the method, as illustrated below, is to be adopted for computing emoluments of running staff for working out their retirement benefits: -
Basic Pay (BP) = Rs.5,000
Dearness Pay (DP) = Rs. 2,500 (50% of BP)
Pay element (@55%) = Rs.4,125 (on BP+DP)
Emoluments = Rs.11,625/-
3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

2. References have been received from some of the Zonal Railways regarding the method to be followed for calculation of emoluments of Running staff consequent upon issue of Board's letter No. PC-V/2004/A/DA/1 dated 11.3.2004 (RBE 57/2004). It is advised that w.e.f. 1.4.2004, emoluments of Running staff have to be calculated as shown in Illustration below:-
1. Basic Pay (BP) = Rs. 5000.
2. Pay element @ 30% of BP = Rs. 1500.
3. Dearness Pay (DP) = Rs. 3250 ( Computed on BP+30% of BP).
4. D.A. = Rs. 1073 ( 11% of BP+30% of BP+DP).
5. Total (1+3+4) = Rs. 9323.

Subject :- Merger of 50% of Dearness Allowance/ Dearness Relief with Basic Pay/ Pension to Central Government employees - Clarification regarding.

Reference : Board's letter of even number dated 11.3.1004 (RBE 57/2004).
Pursuant to the Board's letter mentioned above, refrences have been received seeking clarifications on certain aspects regarding inclusion of Dearness Pay for various purposes. In this regard, following clarifications are furnished:-
a. All allowances such as Dual Charge Allowance, Subsistence Allowance, Teaching allowance etc which were hitherto being calculated on the basis of the Basic Pay will be calculated on Basic Pay plus Dearness Pay. However, Overtime Allowance (OTA), which is presently payable with respect to IV CPC scales shall continue to be regulated with respect to such scales.
b. Dearness Pay shall be variable consequent upon increase or decrease of Basic Pay in the event of annual increment, promotion, punishment etc.
c. Amount to be recovered at the time of retirement towards CGHS/ RELHS shall be calculated on the basis of Basic Pay plus Dearness Pay.

Pay –It includes--
Pay as defined in Rule 103 (35);
Pension and/or Pensionary equivalent of other forms of retirement benefits subject to the provision in Note 2 below, if any, drawn by re-employed pensioners.
NOTE 1. - 30% of basic pay of running staff will be treated as pay representing the pay element in the Running Allowance. From 1-8-1981, Dearness Allowance, and Additional Dearness Allowance at the appropriate rates as sanctioned by the government from time to time shall be paid on the basic pay plus the pay element of the Running Allowance viz. 30% of the basic pay.

Most of the pensioner of Railway Running Staff retired between 01.04.2004 & 31.01.2005 are paid actual 50 % of basic are unhappy with policy . They have been deprived of their legitimate right as Pay element of 30 % on 50 % of DA w.e.f. 01.04.2004 which actually has been drawn by them in last salary and distinctly shown as Dearness Pay and formed part of their Average Emoluments for the purpose of calculating monthly pension as per rule 49 & 50 of Railway Pension Rules 1993. Pay Element of 30 % is also known as emoluments which are specially classified as Pay by President under clause (iii) of code 1303 R II / 1987 edition (Para 103 (35 R I / 1985 edition). The SCPC recommendation is silent on the 30% pay element on DP mentioned above. What was the idea behind calculating 30 % pay element for dearness pay and not calculating pay element as mentioned above which has resulted ultimate loss to the pensioners as mentioned above. Exclusion of the effect of merger of 50 % in SCPC, will it be justified in law @ loss to the pensioners retired between 01.04.04 and 31.01.05.
From the above it is clear that DP drawn in the salary
of BP 5000/- is 3250/- and calculated for the purpose of pension is 2500/- where as rule 103 (35) and instructions in rule 49 &50 of Railway Pension Rules 1993 say some thing else. In the name of pending receipt of recommendation of committee on running allowance 2002 it is not justified to put present pensioners from 01.04.04 in loss. This aspect needs attention of govt.

The minimum scale for ALPS to be much more than clerical staff., here clerk got 4500 in next promotion, where as ALP got 4000,
here clerks are restricted to sip a coffee for once in hour strictly.
